1. Acceptance of These Terms

By using PengCBA —Engineering CBA Assessment Services (the "Website"), submitting an inquiry, or purchasing any service, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Website or purchase services.

2. Our Services

We provide Competency-Based Assessment (CBA) support for P.Eng. applicants: DIY toolkits, draft reviews, red-flag checks, revision services, 1-on-1 coaching, and full-service preparation support. Services are advisory and editorial in nature; we never write or submit an application on your behalf. You remain the author and owner of your submission and are solely responsible for its accuracy, honesty, and compliance with your regulator's rules, including any requirement that the work represent your own experience.

3. No Guarantee of Licensure Outcomes

Assessment decisions belong exclusively to your engineering regulator (PEO, APEGA, EGBC, or any other association). We do not and cannot guarantee that any regulator will approve your application. No content on this Website constitutes legal, immigration, or licensing advice.

4. Orders, Payment and Taxes

• Prices are listed in Canadian dollars (CAD). Applicable taxes (GST/HST/QST) are added at checkout and shown before you pay.
• Payment is processed securely by Stripe (cards) or PayPal, or by Interac e-Transfer for manual payments. An order becomes active when payment is received or, for manual payments, when your transfer is confirmed.
• A receipt/invoice is issued for every paid order. Keep it for your records.
• Premium and full-service packages may be quoted individually; the confirmed quote replaces the listed "starting" price.

5. Delivery, Revisions and Timelines

• Estimated timelines are shown per package (e.g. 5–7 business days for reviews, 3–5 weeks for full-service preparation) and begin once we have all required materials from you.
• Every package includes at least one revision cycle; some packages include more, as described at purchase. Revision requests must be submitted within the revision window stated for your package.
• Delays caused by missing information or slow client responses extend the timeline accordingly.

6. Refunds and Cancellation

• Digital products (DIY Toolkit): non-refundable once accessed, as access is instant.
• Services not yet started: full refund on request.
• Services in progress: partial refund proportional to work not yet performed, at our reasonable discretion.
• Completed deliverables: non-refundable.

Nothing in these terms limits rights you have under applicable consumer-protection legislation.

7. Acceptable Use

You agree not to: misuse the Website or its tools (including the CBA generator and chatbot); submit unlawful, fraudulent or misleading content; attempt to breach security or access administrative areas; scrape or bulk-copy content; or use the Website in any way that violates applicable law. We may refuse service or cancel orders that violate these terms.

8. Intellectual Property

All Website content — text, templates, toolkits, the CBA generator logic, graphics and branding — is owned by or licensed to us and protected by copyright. Purchasing a service grants you a non-exclusive, non-transferable license to use the delivered materials for your own P.Eng. application. You may not resell, republish or redistribute our templates or toolkits.

9. Confidentiality

We treat your documents, drafts and personal information as confidential, as detailed in our Privacy Policy. You are responsible for ensuring you have the right to share any third-party information (e.g. employer details) you provide to us.

10. Reviews and Testimonials

By submitting a review you confirm it reflects your genuine experience and grant us permission to publish your name, role and review text on the Website. Reviews are moderated; we may decline or remove content that is unlawful, abusive or unverifiable. Reviewer email addresses are never published.

11. Third-Party Services and Links

The Website integrates third-party services (Stripe, PayPal, engineering regulators' portals, Google). We are not responsible for their content, availability or policies. Your use of those services is governed by their own terms.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from a service is limited to the amount you paid for that service. We are not liable for indirect or consequential losses, including regulator decisions, application delays, lost income or lost opportunities.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from your breach of these terms, your misuse of the Website, or false or misleading information in your application materials.

14. Governing Law

These terms are governed by the laws of the Province of ON and the federal laws of Canada applicable there. Courts in that province have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your province of residence.

15. Changes to These Terms

We may update these terms from time to time. The version posted on this page, with its "last updated" date, applies to orders placed after that date.
